ACCEPTANCE

Use of this site constitutes your acceptance of these Terms and Conditions hereunder which take affect on the date from which you first use the site.

DEFINITIONS

1. Reference on this website to “Legal Practitioner” includes solicitor, lawyer, and barrister admitted to practice in Australia.
2. Reference on this website to “Associate” includes all Legal Practitioners, advertisers, companies, firms and registered businesses involved with the website, and any/all other websites owned by Fernbee Holdings Pty Ltd and also includes Associates of those Associates.
3. The "Client" means all members of the public who access this site and submit a query.

USE OF website

1. The use of this website is free and does not constitute, in any manner, a solicitor-client relationship. Any telephonic or electronic communication received by the Client from LegalHelpCentre.com.au or its Associates does not automatically create a solicitor-client relationship unless the Client directly instructs the Associate to do work on the Client’s behalf or if the Client and the Associate enter into an agreement for the Associate to provide legal services to the Client. The Client should be aware that the Client’s relationship with the Legal Practitioner will be governed by a separate retainer agreement between the Client and the Legal Practitioner. The Client should ensure that this retainer agreement is acceptable to the Client.
    
2. Where the Client sends an enquiry to LegalHelpCentre.com.au, LegalHelpCentre.com.au will transmit the query to Legal Practitioners who have retained LegalHelpCentre.com.au and who will endeavor to respond to the Clients enquiry within 2 business days (except from the Friday before Christmas to the 8th January the following year and public holidays) of receiving the said enquiry by telephone, provided always the information is complete and has sufficient details and relevant information reasonably required in providing a response. The sending of a query by the Client to the website and/or by LegalHelpCentre.com.au to an Associate will not in itself result in a solicitor/client relationship. If the Client is unavailable on the nominated telephone number(s), the Legal Practitioner will attempt to send the Client an e-mail saying that contact has been attempted. The Legal Practitioner will not make any further contact with the Client. If the Client has made similar enquiries to other sites owned by Fernbee Holdings Pty Ltd, the Legal Practitioner(s) will only respond to one of those enquiries. LegalHelpCentre.com.au accepts no responsibility for enquiries that are not responded to within the specified time, or at all, for any reason whatsoever.
   
   
3. The Client agrees that LegalHelpCentre.com.au will not respond to those enquiries which it deems, in its sole discretion, to be mischievous, offensive and/or unlawful.
   
   
4. The Client agrees to use this site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of defamatory, obscene or offensive content or disruption of the normal flow of dialogue within this site.
   
   
5. The Client agrees and acknowledges that LegalHelpCentre.com.au may refer any or all enquiries received through the use of the website to a Legal Practitioner(s) qualified in providing competent professional legal advice and chosen at the discretion of LegalHelpCentre.com.au. LegalHelpCentre.com.au charges referral fees to Legal Practitioner(s) participating in this service. Referral fees are governed by separate private agreements between LegalHelpCentre.com.au and the Legal Practitioner(s) or between one Legal Practitioner and another Legal Practitioner. (The Client does not pay LegalHelpCentre.com.au any referral fee and transmission of information to the Legal Practitioner does not create an agent/client relationship between LegalHelpCentre.com.au and the Client).
   
   
6. The Client acknowledges that there are time limits pursuant to various Statutes of Limitations which may apply to his or her legal matter and LegalHelpCentre.com.au is not responsible for any delay in bringing proceedings of whatsoever nature, before a Court of competent jurisdiction.
   
   
7. By using this website, the Client is agreeing that under no circumstances will LegalHelpCentre.com.au be responsible for the following:
   (a) any information contained on, omitted from, or linked to or from the website;
   (b) any Client or other person’s reliance on any such information, whether or not the information is correct, complete, or current;
   (c) the consequences of any action the Client or any other person takes or fails to take, whether or not based upon information provided by or as a result of the direct or indirect use of this website;
   (d) any Client or other person’s dissatisfaction with the services rendered by LegalHelpCentre.com.au or any Legal Practitioner referred to the Client by LegalHelpCentre.com.au;
   (e) the results of any advice given by the Legal Practitioner.
   
   
8. LegalHelpCentre.com.au does not warrant that this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs.
   
   
9. These Terms and Conditions shall be governed by and construed in accordance with the laws of South Australia. Disputes arising hereunder shall be exclusively subject to the jurisdiction of courts of South Australia and the Client agrees to submit to the laws of that jurisdiction.
   
   
10. This Site and these Terms and Conditions may be changed by LegalHelpCentre.com.au at any time without notice. The Client accepts that it is the Clients responsibility to review the Terms and Conditions for changes every time the Client accesses the website.
    
    
11. These Terms and Conditions incorporate by reference any notices contained on this Site and constitute the entire agreement with respect to the Client’s access to and use of this Site. If any provision of these Terms and Conditions is found to be void or unenforceable by a Court of competent jurisdiction, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
    
    
12. If any information provided by Client is untrue, misleading, inaccurate, incomplete, deceptive, defamatory or in any other way offensive, LegalHelpCentre.com.au reserves the right to refuse future use of the service by Client.
    
    
13. LegalHelpCentre.com.au may at any time, without notice immediately terminate this agreement and the Client’s use and access to the website.
    
    
14. LegalHelpCentre.com.au does not warrant or guarantee or make any representation about, the quality, competence, or extent of any services (including but not limited to legal advice) provided by any Associate as a result of a referral or recommendation by LegalHelpCentre.com.au. 
    
    
15. LegalHelpCentre.com.au is not a party to any agreement between the Client and any Legal Practitioner that results from the Client's enquiry.
    
    
16. LegalHelpCentre.com.au does not warrant, guarantee, or represent that any Legal Practitioner who the Client may be referred to or who may contact the Client through a referral will agree to represent the Client or provide the Client with any legal advice.
    
    
17. LegalHelpCentre.com.au does not warrant, guarantee, or represent that any Legal Practitioner who the Client may be referred to or who may contact the Client through a referral will not act for the Client in a negligent manner or an unprofessional manner or a manner that might constitute professional misconduct.
    
    
18. LegalHelpCentre.com.au may in its sole subjective discretion choose not to act upon and may delete at its sole subjective discretion any email or message the Client submits to it.
    
    
19. The Client’s use of this website is at the Client’s risk and LegalHelpCentre.com.au is not responsible or liable for any claim, loss, or damage, of any kind, directly or indirectly resulting from the Client use of this website or the information or the resources contained on or accessible through it whether from negligence or other cause or both, including but not limited to damage caused by legal representation, or a failure to receive legal representation caused by negligence, unprofessional conduct or professional misconduct from a lawyer or legal practice that the Client may come into contact with or be referred to by LegalHelpCentre.com.au.
